So in the initial proposal back in 2014 TC actually did have a carve out for commuting which was removed fairly quick. Now with the way the Reg is printed the only carve out that I can see is with the caveat of acclimatization, and it would only come up if something were to happen. I.e. a YVR commut...

The deal isn't done yet. It's only an amended price per share which will need to be approved by the shareholders. You are correct. However if you look at the current economic climate and what the options are; 1) Potential risk of losing everything, or 2) Take a small lose and salvage a little bit.
