Re: Montreal CTV News: Air Transat could turn to foreign pi

I recommend we ban Air France from flying to Canada. They had a runway excursion in YYZ and from what I understand both pilots were French!!

Gilles:

I hope this is not your real everyday attitude:
A Union's goal is supposed to protect its members against the the employer, not against the competition.
You are fighting globalization. Good luck.

Re: Anyone have a TP-2943 Personnel Licensing Procedures Man

I would say right cause, wrong track! I will ask one more time: Is this a genuine aviation SAFETY issue or a labour and immigration issue? Don't give me the "you don't read my posts" because "TC is supposed to uphold all the rules".

Re: Letter to Jean Francois Mathieu TC Chief enforcement off

Insurance companies are always looking for reasons not to pay out so I am not so sure they see unqualified pilots as a negative.

Re: Letter to Jean Francois Mathieu TC Chief enforcement off

Let me approach this from a different angle. Should FLVCs be issued for general commercial line flying? Absolutely not. Is it the intent of the CARs to allow TC to issue FLVCs for general commercial line flying? Probably not. Is there anything in the CARs that clearly prohibits it? In my opinion, no...

Re: Letter to Jean Francois Mathieu TC Chief enforcement off

Gilles: I do read your replies. What suggest that I am not reading them? Is it the fact that I am standing by my opinion regardless of what you throw at me in terms of references and interpretation? Just because a handful inspectors agree with you isn't unanimous with success in a court. You said it...

Re: Letter to Jean Francois Mathieu TC Chief enforcement off

First of all, you might as well forget about "public interest" as it has yet to be legally defined. The problem is that someone could easily argue that nowhere does the CARs state that a pilot CAN NOT fly commercially with an FLVC. Yes, the CARs lists what FLVC can be issued for but does not clearly...

Re: Letter to Jean Francois Mathieu TC Chief enforcement off

Against a good lawyer, 421.07 (2) (j) will not find a foot to stand on. Evrything supports my position. 421.07 (2) (j) by itself and taken out of context will not stand a chance. I don't think context, purpose or intent means anything in a court. Only the legal interpretation of the wording of the ...

Re: Letter to Jean Francois Mathieu TC Chief enforcement off

I sincerely hope you are successful in your fight for reciprocity, but also hope you are not relying on TC not issuing FLVCs on your quest ...

If Flaherty sticks to what is indicated in this excerpt from last weeks Macleans things are not going to improve anytime soon! “Mr. Speaker, the Conservatives’ planned cuts will make travellers less safe in the air, on the water, or riding the rails,” Olivia Chow declared. “The minister has repeated...

Re: Email to the President of Lloyd's Canada

A Foreign Licence Validation Certificate is not and never has been a "licence, rating or and endorsement required by Part IV" for Part VII operations You are right. The Certificate, usually in the form of a letter from TC, gives you the right to exercise the privileges of a Canadian CPL or ATPL in ...

Re: Letter to Jean Francois Mathieu TC Chief enforcement off

The purpose of the "Certificate" you speak of, is a certificate to provide documented proof (usually a letter) for a foreign pilot to carry around showing that his or her Private, Commercial or ATPL license has been validated by TC for the timeframe stated. What does the certificates these foreign p...

Re: Letter to Jean Francois Mathieu TC Chief enforcement off

I am repeating myself now, but 705.106 does not clearly exclude FLVCs either. One could probably argue that when validating a foreign license it is a form of endorsement. 705.106 includes the word "endorsement" but when you look at the application of Part IV there is no mention of endorsements. If y...

Re: CTV news story on foreign pilots in Canada

As much as I disagree with the very imbalanced reciprocity scheme some airlines are engaged in, the safety approach is weak at best. My understanding is that all foreign pilots flying for CJ or Sunwing are current and experienced on the NG, and from what I hear, some have 20,000-30,000 hours on 737'...
