You are correct. The WJPA is a legal fiction. But it works for me and the majority of pilots. Our employment rules are still covered under the common law of employment contracts and part 3 of the CLC, just not part 1 (the part that deals with unions). How would a union (other than being certified) be different from your existing "association"? It's the certification that makes all the difference! The existing "Association" is nothing, legally.
