Hey.. I did the commute YVR-YYZ for 9 of the last 11 years(started as a new hire and just got YVR base in the last year), not hard at all, however it's not for everyone, you have to have the right mind set. I ALWAYS left the day before so I could get a good rest in before checkin in YYZ, I had a cra...

Re: Mandatory Retirement Repeal Passes 2nd Reading in Parlia

accumulous Pretty much wrong on all of that. wander into a TC office and advise the boys in there that TC is heretofor out at 65 Wow who was talking about transport? They can work as long as they want they don't have to follow ICAO 65 rules.... anyway  You must be right you said so,and you u...

Re: Mandatory Retirement Repeal Passes 2nd Reading in Parlia

Those are the facts, albeit with a lot of “if‘s , could and most likely” here and there, but as Ray is smarter than me he must be right. My guess as to what happens, The law changes next Nov to no more mandatory retirement (that's a given) Over the next year Air Canada pulls out the big guns and arg...

Re: Mandatory Retirement Repeal Passes 2nd Reading in Parlia

Trying to understand Ray, How can you.... If those terminations occurred prior to the legislative change coming into force (November, 2012) and if the Tribunal and/or the Courts find that the terminations violated the law prior to its formal repeal ....violate a law prior to it becoming law? If it h...

The issue is no longer which carriers in Canada are age 65 airlines, but rather which ones are not? Only 1
Good point, by the way how many are post age 65 airlines?

Re: Mandatory Retirement Repeal Passes 2nd Reading in Parlia

Ok I follow you so far.... But don't you still run into a problem when someone works past 65 because of the ICAO over under rule? as in up to a 65 limit no problem but if Capts become F/O's at 66 doesn't the undue hardship re appear based on sked problems due to 2 in the cockpit over 60? ????? 29che...

Re: Mandatory Retirement Repeal Passes 2nd Reading in Parlia

OK so I'm a little mixed up but my question stands would the decision have been different had AC been saying 65 instead of 60 The Tribunal, in the Thwaites case, found that Air Canada failed to meet its onus to demonstrate that keeping pilots over age 60 employed would cause it undue hardship. would...

Re: Mandatory Retirement Repeal Passes 2nd Reading in Parlia

Not really what I asked but I see what you are trying to say. Correct me if i'm wrong but I thought the BFOR argument failed [429] At the end of it all, my opinion is that Air Canada has not met the burden of proving that it will suffer undue hardship with the elimination of the age 60 retirement ru...

The normal age of retirement is the last issue, and it has gone to JR. As will each and every case from all parties.
Ah but if 60 was the old normal what is the new normal????

just wondering?

I thought both th...
