That’s one of the misconceptions, imo. Why does it have to be ‘ACA bargaining capital’? Air Canada should WANT this. A steady supply of trained ATPL pilots. Nobody at Jazz wants DOH. Put us at the bottom of the list, give new hires at Jazz an AC number DOH. Hire OTS in between DOH. It affects not one current AC pilot. This was how I understood it playing out also. Hence the interference allegations and the common employer allegations. It is very complex. Any Jazz pilot ‘trying to get on the seniority list’ at AC is doing it through the flow agreement. Which, granted, has/had its shortcomings. Hence the ULP. Also, Air Canada actually ‘owns’ 10% of Jazz. Don’t know how much more ‘common’ it could get…well, I guess, about 90%, but still. Can you sight another example of your ‘cost plus CPA’s’ Bede where the other company gave two shits what the others companies bottom line was? I am unaware of any.

That NDA surely would be expired by now as it did not hold any ‘trade secrets’ and would not have indefinite obligations. The company would have records of their original offer and the CIRB would be compelled to take that into account as evidence. Just my humble, non legal, probably bullshit opinion...
