"Aerial sightseeing only" need an AOC?

    Just going through the TC site involving the different types of air services under Nafta and the Non-requirement of an OC and I'm not sure if only sightseeing business does not require an OC.
    I thought you needed one, if anyone knows more share if you like.

    I noticed this too. I'm pretty sure it needs one, but the CARs seem to imply it doesn't. 705 says it doesn't apply to sightseeing, but the CARS say you can do sightseeing with an FTUOC.

    I might be wrong, but it might be implying for foreign operators operating SAS under NAFTA that a AOC isn't required, because in the US, SAS doesn't need an AOC (they can operate without one under Part 91).

    703 applies. See 703.01.

    I'd look into 702 as well, you aren't specifically transporting people or goods. Sight seeing could be considered aerial work and qualify for 702.

    Having said that, it would suck to limit the operation. 703 isn't that much more work and now you are allowed to do charters too.

    I didn’t read the question carefully enough. For Canadian operators sightseeing isn’t distinguished from other passenger carrying operations: it’s the kind and size of aircraft that determines whtether its 703, 704 or 705 that applies, or Part IV for an FTU. Never, as far as I can see, 702.

    But the question was about NAFTA and US operators operating in Canada.

    says:
    “Sightseeing operations shall be conducted by operators certificated by their national CAA for commercial passenger-carrying operations.”

    That might be all you get in writing, without an enquiry to the right person inside TC.

    Sightseeing is absolutely type of aerial work that can be applied for under 702. The catch is you need to take off and land at the same point. Add a second airport in the mix and that’s air taxi or 703.

    Second page of the application for a 702 AOC tells you all the different types of aerial work that can be offered.

    That form is for an aerial work OC. It doesn’t say “702”. If you apply for an OC for sightseeing with that form then 703, 704 or 705 will apply to you.

    Look at the actual regulations.

    702 begins:
    Subpart 2 — Aerial Work
    Division I — General
    Application
    702.01 (1) Subject to subsection (2), this Subpart applies in respect of the operation of an aeroplane or helicopter in aerial work involving

    (a) the carriage on board of persons other than flight crew members;
    (b) the carriage of helicopter Class B, C or D external loads;
    (c) the towing of objects; or
    (d) the dispersal of products.

    (2) This Subpart does not apply in respect of the operation of an ultra-light aeroplane, or in respect of the operation of an aircraft in aerial work involving sightseeing operations.
    703 begins...
    Subpart 3 — Air Taxi Operations
    Division I — General
    Application
    703.01 This Subpart applies in respect of the operation by a Canadian air operator, in an air transport service or in aerial work involving sightseeing operations, of any of the following aircraft:
    Similarly, 704 and 705 apply to sightseeing in bigger aircraft.
