Drew:
I just can't believe it, you say that you found Transport Canada Inspectors to be helpful? That just can't possibly be true ... it simply flies in the face of all the posts I see here often, and as Judge Judy says "if it doesn't make sense, its not true."
Didn't they shake you down for "plain brown envelopes" during questionable secret meetings where you were held incommunicato behind closed doors with TC personnel? Didn't you feel like you were a Guinea Pig in a room with a Boa Constrictor? I'll bet they said they closed the door for the protection of the privacy of your business information didn't they? Yeah, sure. I'll bet they just couldn't wait to connect electrodes to your genitals and start cranking the magneto to make you give up your corporate secrets so they could pass along your contracts to other scumbag operators who kill people regularly, but make their weekly protection payments on time.
Please don't try and tell us they were helpful, because its just too much for any thinking person to handle.... a concept as wild as the flat earthers must have felt when they first heard someone putting forth the concept of the earth being round.
I sure hope that you told someone where you were going when it came time to go to the TC office, after all, ..... I've heard of operators just disappearing without word when they go to the TC equivalent of Lubyanka Prison. You could have ended up at the local landfill as just another unknown, unidentified skull with a 9 mm diameter entry wound.
Tell us, when you woke up on the concrete floor with a few hours missing from your memory, did your bum hurt? Did you have a sort of stale, musty taste in your mouth? Did you think you had been abducted and "probed" by aliens?
Again, I only ask because it seems so many people on the forum have been for certain ... or should I say "allegedly" ....gang-raped by Transport Canada Inspectors. I'm certainly so intimidated that I could never, ever, screw up the courage to to apply for an AOC in my own name. I think I'd rather have Clifford Olsen invite me to a drinking party on a pig farm in Mission, BC.
Drew, I applaud your bravery ... to actually enter the lair of the dragon-beast of Canadian aviation and emerge with an AOC is nothing short of miraculous. You are a man who stands torso, head and shoulders, above most in Canadian aviation. Because of AvCanada's forum, you may develop a cult personality as great as King George The Dragon Slayer.
Either that, or the doom and gloom predictors who post regarding the background, knowledge and conduct of TC Inspectors here regularly were simply ... full of crap, and much of their future information should be run through the fine meshed "BS filter" and treated as such.
I was always treated appropriately by TC Inspectors, with only a single exception ... but I suppose that's all it takes to ruin the work done by the dozens of others with whom I had contact over the last 3 decades.

Common sense dictates that most people will go through the process and not run into problems.I'm really glad it worked out for you.
I did for almost fifty years.
That is the bottom line.Free advice: don't EVER piss them off, or argue
with them, especially if you are right. Never,
ever challenge their authority.
It matters not what the regulations or their own policies claim, their inspectors can and will and do deny you anything they want to and you have no recourse.
Here is part of the reason.
From T.C....... An inspector who discharges his or her duties fraudulently or negligently or in some manner that is contrary to the employer's instruction will still be considered to be acting "in the course of employment" because the person is doing his or her job, albeit improperly. In such case, the crown will defend and indemnify the individual respecting claims made by a person suffering injury or damages.
So they even put it in writing that they will defend negligent inspectors, that commit fraud.

Re: advice for starting a charter compamy
That would be true if an employee is working in “good faith”, but if an employee is intentionally or wilfully acting outside of his authority the Crown may leave him to hang in the wind on his own. I’m sure someone will correct me if I’m wrong, but I think this would be true of most large employers in that the employer must defend its employee in order to defend itself—any law suit will include not only the employee but also the employer. And of course everyone tries to sue the Crown because they have deep pockets. An inspector who discharges his or her duties fraudulently or negligently or in some manner that is contrary to the employer's instruction will still be considered to be acting "in the course of employment" because the person is doing his or her job, albeit improperly. What hasn’t been mentioned is the disciplinary action taken against an employee that gets himself sued if he wasn’t following policy and procedures.

So when Preuss and Nowzek were found to have denied me due process that is acting " in good faith " ?That would be true if an employee is working in “good faith”, but if an employee is intentionally or wilfully acting outside of his authority the Crown may leave him to hang in the wind on his own.
What did the crown use as a mitigating factor, they are unable to differentiate between right and wrong therefore they were deemed to be acting in good faith?

...kinda makes me wonder why nobody on here ever sued TC. If you have a slam dunk case against them it shouldn't be to hard to find a lawyer to take the case on spec (hell....you might even find some young idealist that will do it pro bono.)Prairie Chicken wrote:And of course everyone tries to sue the Crown because they have deep pockets.

Re: advice for starting a charter compamy
The reason is quite simple....kinda makes me wonder why nobody on here ever sued TC. If you have a slam dunk case against them it shouldn't be to hard to find a lawyer to take the case on spec (hell....you might even find some young idealist that will do it pro bono.)
In my case after spending a lot of effort in trying to find a law firm to sue the crown the best I could find was if I was willing to put up $250,000.00 cash in front they would take my case on......they also said that would be about the maximum I could hope to win.
So I did it another way and won my case against them.....however getting my $250,000.00 that was the agreed upon amount they were to pay me has not happened yet.
Please do not respond with any comments that I am claiming something that is not true, because I have the documents to prove it...just haven't got my money yet.

Good point. I heard about one the other day....serious diciplinary action...cut off donuts for a week, not allowed to carry his brass knuckles on inspections anymore, must speak only English in head office, and no longer allowed to post the official TC mantra on this website...serious discipline.

The Old Fogducker's free advice:
Don't take advice in effective interpersonal communications from some of the most "popular posters" on the forum. You can see how successful they have been in getting along with the agency who controls whether they obtain/retain an operating authority.
In my case, I challenged the POI for our company many times, and in the majority of cases, they "won" but always provided the full reason for their decisions or regulatory interpretations. Sometimes I was the "winner" and demonstrated that I could be in compliance by means other than that envisioned by the Inspector.
These "challenges" were never "contests" to see who was right or who was wrong and the methods I used to "challenge" the POI were a great deal smoother than "F You, you tin-horn government C sucker, why don't you get a real job? Oh, I forgot, you couldn't make in the real world!"

I have been very successful Fog, in fact I have an excellent working relationship with several foreign regulators and hold licenses in the following countries.....United States FAA.....Australia CASA.....Europe JAA...Where I hold several authorizations in aviation as well I was recruited by one of the top people in the Greek HCAA as an adviser in their regulation office and am in good standing there..Don't take advice in effective interpersonal communications from some of the most "popular posters" on the forum. I would hazard a guess that in Canada I have held more positions in aviation management including working with TCCA than you, so your opinion is just that...your opinion.

Re: advice for starting a charter compamy
And the truth is I have many friends in TCCA as evident by the collection of internal documents marked " Protected " that like magic appeared in my hands in plain brown envelopes.
Which helped me to expose the underbelly of the beast.
So how do you explain that Fog?
Trey there are three of us here who have concerns about how the regulator is run who are up front with our identity Hedley and I are just common grunts in the industry, widow is special.

You have a great deal of information, experience and certainly no shortage of personality to bring to the "youngsters" of aviation. Unfortunately, you seem so consumed by your past "difficulties" with Transport that it has been a very long time since you made any positive contributions to those who could most benefit by your professional guidance.
Perhaps I'm wrong ... and I sure admit I could be, because I haven't done a numerical study of your posts to determine the ratio of rants compared to genuine assistance. Every now and then I seem to reach my boiling point with nothing but bitching, ranting, and raving from you and Hedley about what scum-sucking dogs any and all Transport employees are, because that is not my experience.
You (and others) cry for change and reform at TC as if you were doing door to door campaigning for Obama, but whenever you get the chance .... or create one by barging into a thread like a bull in a china shop, you take a huge crap on everyone at TC from the building janitor to the Minister of Transport.
With this type of drivel distorting or questioning the conduct, morals, professional background and qualifications, etc of TC folks, you have likely scared away some very good people who might actually have made excellent inspectors and done something positive for the business and pilots that read these forums. Instead, you (and others) have resorted to the internet equivalent of scribbling graffiti on the washroom wall of a cheap diner.
Again Cat, you have a hell of a lot to offer, but sometimes you just appear to be wallowing in self pity rather than being a "force for good" for those still in the industry. If you even cut the percentage of TC bashing to just 50% of your posts, it would change the way I view your on-line "persona." Not that my opinion means anything more to you than a gob of snot on the sidewalk.
You are right indeed ... its my opinion...and the great thing about being in the free world is that I'm entitled to speak my opinion, just as you are.

Re: advice for starting a charter compamy
Fog, that was a real decent post and I am sure you have your heart in the right place.
It would be disingenuous of me to pretend that I do not turn some young people away from wanting to be part of TCCA, and the reason is I truly believe that regardless of their intent to bring about change from the bottom up they would not succeed becaust the problem stems from the top down.
As to what these very good people may be able to change read my comments above.
With all due respect the very last thing that can be said of me is I wallow in self pity, you have mistaken my dedication to expose the rot at the top to be self pity when in truth I put my career and reputation on the line to maybe bring about change...where it must be done, from the top down in TCCA.
We can start with Merlin Preuss.
And you can bet your ass there wouldn't be a chance in hell of any young dedicated person who joined TCCA to even start rooting that disgrace to aviation out of his office.
I at least am trying and it is evident I think I have done a good job in getting him boxed into a corner....it is not like he does not know who I am and what I have to back up my allegations.
Nothing personal Fog, but it might be better if you have another go at trying to second guess my motives.
O.K?

You are incorrect Fog, I am very careful to identify by name and position those within the structure of TCCA who I can prove abuse the power of the office they hold, and I can assure you none of them are janitors.... or create one by barging into a thread like a bull in a china shop, you take a huge crap on everyone at TC from the building janitor to the Minister of Transport.

Foggy:
Actually, the type of people who would make good enforcement types are quietly waiting for the finishing up of their assualt charges and getting the boot from the force. Perhaps TC's recruitment efforts could be better directed from having a bunch of hacks painting over the anti-TC graffitti here, and replacing it with pro TC graffitti, to scouring newspapers for policeman that beat up homeless people..after all, TC could provide them with assurances that that type of behavior will only get you promoted.
Balance is everything Foggy. Dont come on here and attack, however subtlely you feel you are doing it, using the same type of extremist methods. If you dont think TC has some problems and needs to clean out more than one or two of the bad apples (or "McCrits", as we like to call them), you really need some perspective too. And dont feed me the old "everyone or every organization has its problems" I hear enough of that when I am interviewing a stupid pilot after an accident. The difference between a good organization and a bad one, is the good one accepts criticism and seeks to changes itself internally. A bad one attacks and attempts to silence those who point out its defects. The frustration of many which leads to some rants is that TC very much favors the latter...including having employees, retirees etc. coming on here to spout the official mantra..With the one excpetion of TC Guy (who apparently was silenced by TC!!!), I have not noticed any one of the mantra team ever acknowledge any problems within except to rationalize them as above.
What I dont think many of the pro-TC types even realize is their posts here are all almost identical also..and I mean from poster to poster..
Your posts have certainly had an impact on my perspective lately. And from the PM's I am getting, some others also. And by others I mean the young and eager in the business.
Your cleverness, and that of several others may not be working the way you think it is.

trey kule I am pleased you also are getting PM's from people who want the systemic rot within TCCA cut out.
I also get a lot of PM's and e-mails from mostly young people who desperately want to see changes made in the regulator, as it directly affects their careers.
The one thing each of these people have in common is they back me up because I express my dissatisfaction using my real name and back up my allegations with documentation.
Watching the knee jerk defenders of the system jump right in to applaud every post that tries to deflect what I am saying is amusing....some like mcrit are pathetic.

I've always though that someone who has to pay for sex.....and then brags about it on an internet forum.................. is pathetic, but I guess I just don't think like you ..

Fog, I don’t think truth, common sense, and logic are going to work here. TC bashing is just too much fun! Besides, imagine how boring this forum would be if everyone spoke the truth and stayed on topic.

First of all, with regard to the topic. You are quite right, we have strayed. But some of us, including myself chose to give advice through PMs to the original poster. I can not speak for the others, but there was absolutely no mention of anything deragatory in my PM with regard to TC. I think the original poster got the info he requested, but you would maybe have to ask him to post that to confirm it.
It is not about having fun bashing. It is about taking an extreme position to counterbalance the prepetual propoganda TC puts out. And to counterbalance the TC employees, retirees, etc. who like to promote the official TC line. I dont think the pro-TC group on here really represent the rank and file of TC, but that is just my opinion.
I like the approach you use. Trivialize, condemn , and generally marganilize anyone who dares to disagree. But then that is the official TC policy, is it not?
When an organization fails to clean up their act, and one can see the deteriorating qualitiy of the people in the field (in general terms), somebody has to speak up....and if that means continually harping on it, well so be it.
Instead of attacking those who condemn the wrongdoings of some, why dont some of you TC types go take an unbiased look. There is a darn good reason why the new young pilots are scared stiff or retribution from TC if they dare to disagree...and Cat, Hedley , and the others are not the reason..

If you truly believe that the allegations that I so openly make against some of the top people in TCCA are untrue why would you not demand that these people hold me accountable by the simple act of serving me with a subpoena charging me with liable to appear in a Federal court to answer for my allegations?
Or is that to difficult a concept for you contemplate and act on?

Oh, dear God in heaven I am a sinner.
Thanks mcrit for pointing out these flaws I have.
To all you young ones out there who I may have in some way perverted by my shocking lack of character please only strive to mimic the pilot part of me and not what I may have done in moments of weakness after work.
Remember none of us are perfect.
This is what I love about this forum the opportunity it gives one to examine ones past and ones weaknesses so openly evident by the way one forgets to portray a virtuous character devoid of any hint of having strayed from the straight and narrow.I've always though that someone who has to pay for sex.....and then brags about it on an internet forum.................. is pathetic, but I guess I just don't think like you ..
