CPL Training on suspended medical

Hey Everyone,

Was looking for some clarification if possible. I just was notified my CAT 1 renewal was shot down by TC as I had some surgery out of country that they want looked into. My letter says I'm to stop flying immediately... I read what I could in the CARS but I'm unsure if I can continue dual training until its reinstated. Any knowledge from the board would be great.

You wouldn't legally be able to fly as PIC without a valid medical...which is a huge portion of the CPL. What does the letter say though (verbatim)? I imagine it says something like you are unable to exercise the privileges of a Cat 1 medical. Or your Cat 1 medical is no longer valid...or something along those lines? If so, that's not necessarily the same as "stop flying immediately". But without seeing the contents of the letter, no one will be able to say with certainty what you can or cannot do.

When receiving dual instruction you are not the Pilot in Command, the Instructor is. So dual instruction does not require a medical and indeed this is a common situation with people starting their Private Pilot License training. However as pointed out above solo flight would require you to exercise the privileges of a PPL which means you are acting as a PIC , which is not possible without a valid medical

401.26 The holder of a private pilot licence — aeroplane may act as

(a) pilot-in-command or co-pilot of an aeroplane of a class and type in respect of which the licence is endorsed with ratings;

(b) pilot-in-command of an ultra-light aeroplane; and

(c) pilot-in-command or co-pilot of any aircraft for the sole purpose of the holder’s flight training or flight test where

(i) in the case of flight training,

(A) it is conducted under the direction and supervision of a flight instructor qualified in accordance with section 425.21 of Standard 425 — Flight Training, and

(B) no passenger is carried on board, and

(ii) in the case of a flight test,

(A) it is conducted in accordance with section 401.15, and

(B) no passenger is carried on board.
