Will my RAIC be refused?

Post by Satvir1005 »

I just started as a flight attendant 7 months ago received a letter from transport Canada stating my application was under review due to five incidents four of which were of me calling RCMP with concerns of the well-being of a family member. The fifth incident was when this family member had picked me up from a club to take me home and we were stopped by a police officer and ID’ed after that we were told to go straight home. This family member and question had a criminal record for trafficking this family member has since passed away. I have no criminal record whatsoever. Would my relationship with this family member be grounds for the refusal of my RAIC?

Yes, association with drug traffickers is grounds for refusal. Or was it human trafficking?

A story from a few years ago... A Tim Hortons employee in YYZ lost their RAIC due to a family member borrowing her car and attending the funeral of a known gang member. Police were surveilling the attendees and picked up the license plate.

She appealed it in Federal Court and lost.

Doesn't need to be a conviction, but any association with criminal elements can be grounds for ineligibility to hold a RAIC.

Or organ trafficking?

Association with drug traffickers is not automatic grounds for refusal. The test is whether that association gives rise to an evidentiary based belief that it poses a danger to civil aviation.

If four of the five events were because you were concerned that a family member was not doing well, it shouldn’t have any negative impact on your file. Part of me wants to feel bad for you, and tell you you’ll be fine, but part of me also thinks that there’s a lot more to this story than you’re suggesting. I’m pretty sure the RCMP can differentiate between a concerned family member calling a few times for a wellness check than someone who could have a reason to have a security clearance denied.

Best of luck. If it fails, Maybe a lawyer can help you optain the “sacred” restricted access card
