private registered aircraft leased to commercial operator

HI guys,

I know I have been posting questions regarding C of R's and airplanes. I have one question again, can a private registered airplane owned by an individual lease his airplane to a commercial operator which could be used for commercial purposes without the aircraft not being registered to the commercial operator?
If anybody has their opinions on this it would be greatly appreciated.

Here's what I think according to CAR's, please don't rape me if I'm wrong:

I believe even if you own a private aircraft, it must be brought up to "commercial" standards (702,703,704 or 705 ops...). Examples are maintenance, survival equipment, avionics. etc. The aircraft you lease to other companies must be brought to standards as simply leasing an aircraft to other operators is a commercial ops as you are making revenue from these flights. To answer directly your question, the C of R must state it can be used for commercial ops. Also you both have to have commercial air operator certificates.

The short answer is no. The above link only applies to 2 commercial ops.

like it was sort of stated, a private owner has no requirement to maintain the aircraft to a certain standard (MSA, Elementary work, 50/100/200 inspections). When you leased the aircraft to the copany there would be no assurement of the proper maint being done while in private hands.

So if you wished to do this type of thing you would have to be the holder of an OC (403,604,702-705). If you want to fly the aircraft as well as lease it ocassionally, you would be best off to find a management company (OC). Then they (you) would be registered to the aircraft and you could lease it to any company with an OC without even needing the approval of TC. (CAR 203.03 I believe)

It's kind of hard to figure out what you are trying to do but if you could be more specific in a PM I could probably answer some of your questions.

CARS do not apply to airplanes in B.C. they only apply to cars.
Private reg aircraft do Off the books work in B.C. I know off at least three guys who have even used aeroclub airplanes for charter work .Book your flight with @@@@@@@@@ airline and you may get to fly in anything from a buddies 150 ,the club 172 , or a ' borrowed twin ' or if the maintenance is done the aircraft actually on the O.C.
