It was a little before 8 at night when the breaker went out at Emily Milburn's home in Galveston. She was busy preparing her children for school the next day, so she asked her 12-year-old daughter, Dymond, to pop outside and turn the switch back on.

As Dymond headed toward the breaker, a blue van drove up and three men jumped out rushing toward her. One of them grabbed her saying, "You're a prostitute. You're coming with me."

Dymond grabbed onto a tree and started screaming, "Daddy, Daddy, Daddy." One of the men covered her mouth. Two of the men beat her about the face and throat.

As it turned out, the three men were plain-clothed Galveston police officers who had been called to the area regarding three white prostitutes soliciting a white man and a black drug dealer.


All this is according to a lawsuit filed in Galveston federal court by Milburn against the officers. The lawsuit alleges that the officers thought Dymond, an African-American, was a hooker due to the "tight shorts" she was wearing, despite not fitting the racial description of any of the female suspects. The police went to the wrong house, two blocks away from the area of the reported illegal activity, Milburn's attorney, Anthony Griffin, tells Hair Balls.

After the incident, Dymond was hospitalized and suffered black eyes as well as throat and ear drum injuries.

Three weeks later, according to the lawsuit, police went to Dymond's school, where she was an honor student, and arrested her for assaulting a public servant. Griffin says the allegations stem from when Dymond fought back against the three men who were trying to take her from her home. The case went to trial, but the judge declared it a mistrial on the first day, says Griffin. The new trial is set for February.

"I think we'll be okay," says Griffin. "I don't think a jury will find a 12-year-old girl guilty who's just sitting outside her house. Any 12-year-old attacked by three men and told that she's a prostitute is going to scream and yell for Daddy and hit back and do whatever she can. She's scared to death."

Since the incident more than two years ago, Dymond regularly suffers nightmares in which police officers are raping and beating her and cutting off her fingers, according to the lawsuit.
Griffin says he expects to enter mediation with the officers in early 2009 to resolve the lawsuit.

We've got calls in to the officers' lawyer; we'll let you know if we hear something.

Update: This is from the officers' lawyer, William Helfand:

Both the daughter and the father were arrested for assaulting a peace officer. "The father basically attacked police officers as they were trying to take the daughter into custody after she ran off."

Also, "The city has investigated the matter and found that the conduct of the police officers was appropriate under the circumstances," Helfand says. "It's unfortunate that sometimes police officers have to use force against people who are using force against them. And the evidence will show that both these folks violated the law and forcefully resisted arrest."

This would be the same Texas where 32% of Texans believe Obama is a Muslim.
The same Texas where the most miscarrages in of justice in the entire USA happen to blacks and Mexicans by a 5 to 1 margin. I don't believe it. :roll:

I wouldn't highlight Texas as ignorant towards our future President. 57% of those who voted for Obama didn't know who controlled the Senate and the house. So yes, both are very ignorant. I can thank SNL and the Daily show for that.

DR could you clarify what you were trying to say about miscarriage of Justice? I'll love to get into a criminal justice argument/debate, but you need to clarify that statement.

The definition of "arrest" is open to wide interpretation in the criminal justice world. You can be under arrest if I pull you to the back of your car and question you, but not allow you to leave. (not cuffed)

I can also place you in handcuffs, but not arrest you.

My safety as "law enforcement" is paramount. That is why I'm able to handcuff you, but not necessarily arrest you.

Under the CCRF, as soon as I am not free to go, you have detained me. Might be different for Nark, as I think he is down south.

I love the internet. Not only can I turn on the TV or read a paper and see bad, unprofessional reporting. Now I can go online and see bad amateur reporting.

If I read this correctly, she was "kidnapped" by three fully grown men and beaten around the head and face by two of them. Even after this she was able to run away before any intervention by her father. Was she smothered in pig fat? If it's true, the three cops should be fired for inability to detain a slippery twelve-year-old!

Or maybe, the report is a load of crap.

For all I know, Galveston cops may be the worst in the U.S. I'm not defending them. I don't know anything about them.

I do know an insult to my intelligence, however. That report is one.

I find your skills for propaganda to be very well tuned. I find when ever a Texan holds the oath of office the US military has an injection of tax payer money from the budgetary process to fund the skills and teach you and others like you how to use the tools of diversion and redirection.

IABD, Daley was just about as well known for fumbling speeches as GWB is. The quote wasn't at all what he had intended to say. Oh, and his son trashed Meigs Field.

Yes, I know all about Daley. It's kind of hard to express being fascisious on here without facial expressions. I'm trying out a new cyber comedy 'shtick' technique on Nark in misc. forum for my cyber road show I am touring for in January. :wink:

Ok....this has been a huge hijacking of the thread's original topic. Maybe we should return to the topic and not make it about the attention seeker named 'Nark'.

An effective writer knows his audience. They can convey their point, without further explaining what they wrote. This was something I learned in high school English class.

I hate to jump in late with this but… How do you blame the Daily Show and SNL for the voting public not knowing anything about their government or candidates? Isn’t that right up there with saying that because a girl is wearing tight shorts and is black that she is automatically a prostitute? Whatever happened to personal responsibility?

More people watch the Daily Show, SNL or Late Night TV than watch the news. When the writers for the show put their spin on the topic, these morons tend to take it for the truth.

I very much agree with you that more and more people are losing personal pride and responsibility. This isn't just a problem "south of the border" for you folks in Canada. Its all over.

Okay. I see what you are trying to say, I just don't agree with you. It strikes me that if you are not aware of what is going on, you won't "get" the joke being made. So, I guess I see it the other way around... that it is the informed that tend to watch a political comedy show.

But I still fall back to personal responsibility to remain informed. You are correct; ignorance is a universal constant and does not respect international boundaries.

Now, back to the original thread: If this report is at all accurate it does not speak well of the officer’s involved.

To get most of the jokes about Bush or other conservatives, you just have to assume they're morons. You don't need to know shit about the issues, which is the problem. That isn't to say that a lot of those who watch the daily shows aren't informed, but you don't need to be to get most of the jokes.
