Night Ratings CARs Clarification
Hello,
I'd like to sort out a clarification on some information in the CARs. I'm currently working on a night rating to add to my PPL. I have the five hours required during the PPL training. What I'm trying to determine is whether those five hours will count towards the ten total required by TC as indicated here:

DIVISION XII - NIGHT RATING
421.42 Requirements
(1) Private Pilot Licence - Aeroplane
(a) Experience
An applicant for a night rating shall have acquired in aeroplanes a minimum of 20 hours of pilot flight time which shall include a minimum of:
(i) 10 hours of night flight time including a minimum of:
(A) 5 hours dual flight time, including 2 hours of cross-country flight time,
(B) 5 hours solo flight time, including 10 takeoffs, circuits and landings, and
(ii) 10 hours dual instrument time.
(iii) Credit for a maximum of five hours of the 10 hours of dual instrument time may be given for instrument ground time, provided that the total instrument time shall be in addition to the 10 hours night flight time in subparagraph (a)(i) above.

I'm guessing you mean 5 hours of instrument time. They count.

Yes, sorry, I was referring to the dual instrument time. So, that said, I should only need to do an additional 5 with the instructor. Any official-ish references that state this more explicitly?

If it was a post PPL requirement it would explicitly say so,
like the dual training requirement when obtaining a CPL as seen below.
"(ii) following the issuance of a private pilot licence — aeroplane by Canada or another contracting state, have completed 65 hours of commercial pilot flight training in aeroplanes consisting of a minimum of:"
So yes you can count the 5 hours.

As long as we're talking about instrument time...
If someone has 5 hours from their PPL, can the remaining 5 hours be done in a sim? It looks like it would be ok, yet most schools (even ones with a fancy new sim) say no.
