TC Calendar Day

Post by Pandy »

What does TC define as a "Calendar Day"
Technically
Monday 23:30 - Wednesday 00:30 would be 3 Calendar days,
but I highly doubt that that would be what TC is talking about.
CARs 700.19 (1) Subject to subsection (2), an air operator shall provide each flight crew member with the following time free from duty:

(a) where the operation is conducted under Subpart 4 or 5 using an aircraft other than a helicopter, one period of at least 36 consecutive hours within each 7 consecutive days or one period of at least 3 consecutive calendar days within each 17 consecutive days;

(b) where the operation is conducted under Subpart 2 or 3 or is conducted using a helicopter, one period of at least 24 consecutive hours 13 times within each 90 consecutive days and 3 times within each 30 consecutive days; and

(c) where the flight crew member is a flight crew member on call, one period of at least 36 consecutive hours within each 7 consecutive days OR one period of at least 3 consecutive calendar days within each 17 consecutive days.

Nope, they don't and technically, that example is one calendar day (Tuesday). Applied to your example, you were on duty Monday until 23:30. To reset, needing 3 consecutive days free from duty, you would have Tuesday, Wednesday and Thursday off. So at 00:01 Friday, you could be available for duty. The common definition of calendar day is "the period from one midnight to the following midnight". The closest thing TC comes to a definition of calendar day is when it comes to MEL's. For example,"...shall be repaired within 3 consecutive calendar days excluding the day of discovery." So if you deferred something on Monday, you can bet the company would use Tuesday, Wednesday and most of Thursday before rectifying it, if it benefited them. So the same should apply to time free from duty.

@Pratt X 3
I'm sure that's the spirit of what TC means, but there are companies out there that will look to weasel out of giving their employees their proper rest by enacting the "OR 3 consecutive calendar days" & then making sure that it just blearily covers 3 days. What I don't understand, is if TC means the entire day, why did they bother putting the OR in there? They could have just left it at "36 consecutive hours"

(& yes I have a company in mind that's doing that to their 703 pilots)

I thought there was a section in the GC Justice Laws Interpretation Act defining periods of time, but I can't find it right now.
I did come across this guide on the TC site though that defines the intent of the regulation a little clearer:

Actually that link works :)

S740.19 Requirements for Time Free from Duty
(1) Days off (one day equals at least 24 consecutive hours)
