New IFR validity rules.

I would just like to confirm with someone that knows for sure either way, that the new rules regarding a non-expiring IFR rating are currently in effect now.

I have read the advisory circular, and am fairly confident I understand it.

I am working for a VFR operator overseas, and as such, I have a valid IFR rating that is not current anyways. If my rating isn't going to expire at the end of June, as it would have under the previous rules, then I won't spend the money on my renewal, and just maintain my currency by doing an IPC when I'm back working in Canada.

Confirmed. TC will no longer accept fees for the renewal. I spoke to PL at length about it in the interim your sticker will have a valid to date but soon will be replaced with one that just says instrument rating also of note if you have a totally expired rating over 4 years and you wish to renew you no longer have to write the INRAT again. Buy beer instead

The advisory circular does not say anything about the INRAT so AFAIK the requirement to write it after 4 years still exists.

In the associated material that was sent to Pilot Examiners it definitely states that the INRAT is no longer reequired regardless of the length of inactivity.

As far as not being stated in the advisory circular, that actually means it's not required since it is isn't stated as a requirement.

The advisory circular only mentions CAR 401.48 had been rescinded, which was the CAR requiring a Instrument rating flight test every 24 Months.

The requirement to re write the INRAT after 48 months is at CAR 421.49 (4) b

(4) An applicant for the renewal of an instrument rating that expired more than 24 months before the date of application, shall:
(amended 1999/03/01; previous version)

(a) successfully complete the flight test referred to in paragraph 421.46(2)(c); and
(amended 1999/03/01; previous version)

(b) obtain a minimum of 70% in the written examination (INRAT) described in CAR 421.46(2)(a) - Knowledge Requirement.

This CAR is not mentioned anywhere in the circular, so to me that means it is still a valid.

Does anyone have anything in writing from TC that says CAR 421.49 (4) b is no long in force ?

your quoted CAR,s is somewhat vague. It implies you need to write after 24 months.

I too am hearing no more rewrites if you have sucessfully passed it before

I read the quoted CARS,s to say that as well. There is no place that it mentions 48 months.
So where did the 48 months come from?

So where did the 48 months come from?
If your rating has been expired for more than 24 months, you have to do the rewrite. That means your last flight test would have been more than 48 months before, as the rating is good for 24 months and the CAR I quoted is referencing the time after your rating has expired.

Therefore a literal reading of the CAR is if you have not done a IFR flight test in the last 48 months you have to rewrite the INRAT

If TC's intent was that the INRAT was, like the IFR rating, non expiring than they should have explicitly mentioned CAR 421.49 (4) b as been no longer in effect the way they quoted CAR 401.48 ( the requirement to do an IFR flight test every 24 months) as been no longer valid.

So I guess the question becomes whether this was just an oversight in the drafting of the AC or whether it was deliberate.

The direction is that 421.49 still exists In CARS but it is to be ignored and will be removed later. Talk to any PE and they can confirm it.

Just spoke to a TC inspector today(Ontario Region) and she confirmed that the INRAT does NOT have to be re-written, irrespective of how long it's been expired, so long as you've passed it...

I was wondering the same thing. Did a renewal in May, and my sticker says the IFR is good until June 2017. I was not even certain whether the new rules were in effect because my IFR still "expires".

I just renewed July 3rd & was told that I will get 2 stickers,the first with an expiry date of August 1/2017 which came Thursday.the second sticker could be in anything from a couple months to six months will say something to the effect valid with currency provisions.
