I have no issue with this being done. Just another biased sob story one-sided media report. Exactly what the criminals have been convicted of seems to have been omitted from the article. What is the point in jumping through all the hoops we have to renew our RAIC's if they aren't allowed to revoke anyones for having criminal connections? Isn't this is how the system is supposed to work?

Recent, one degree of separation, assistance provided to multiple connections, doesn't really sound like a wide brush to me…hmm...wonder why police surveillance was set up at a funeral?

I don't think this woman has received competent legal advice if she thinks she has a chance of winning. Never seen the Federal Court reverse a decision made by the TC Security Clearance Program Advisory Body yet. I've read a couple dozen so far.
Section 4.8 of the Aeronautics Act states in part “the Minister may, for the purposes of this Act, grant or refuse to grant a security clearance to any person or suspend or cancel a security clearance”. The court has even recognized in Fontaine that includes the "promotion of aviation security". It amounts to basically unfettered power to deny a TSC if there is even reasonable suspicion of wrongdoing, or even susceptibility to be influenced to do something criminal.
There is a case from last year that is pretty much analogous right down to criminals in possession of her car: http://canlii.ca/t/gjc39. The plaintiff in that one even had to pay (limited) costs to the Minster. The woman in the G&M article may lose more than just her RAIC...

Yet try checking in a suitcase with laptop in it. There are very high chances that the computer will be stolen by a RAIC holder. But that is OK.

I remember mid 90's doing a chartered C-206 bush flight which involved picking up tourists in a land strip belonging to a Quebec "Pourvoirie"
Unbeknownst to us this strip was under surveillance by the RCMP as the owner was suspected of doing shady flights with its own aircrafts for the Hell's Angel.
TC brought it to us a few months later during an audit when they realised that one of our registration's tail has been flagged landing there!
They took a copy of the aircraft logbook for this day, with my name nicelly written all over it!
I guess common sens prevalled as I never heard anything about it afterward.
Or Maybe because my name was simply not enter in the system that day to be picked up by an RAIC check years after.

As I read the article I thought it was interesting that the authorities pulled her RAIC without first placing her on notice and doing surveillance on her for a period of time. But...as the story progressed, it seems they did just that. I don't know all the circumstances. Did the cart come before the horse here? Was the RCMP surveying her father and connect the dots that way or were they tailing her and stumbled upon her connections that way? I would agree that simple association is not a reason to pull a RAIC but my suspicion is that it goes deeper.

I'm employed in aviation. Worked on the security side and then management hence my familiarity with the legal side of aviation. I still have an ATPL/Group 1, but don't use it in a practical sense anymore.cncpc wrote:A question to The Stig and Human Garbage...
