It sure has been quiet here lately. Can anyone provide an update regarding what is happening with the Tribunal or with the announced reinstatements?

Probably wont be too much to talk about about the Remedy is release sometime in November. The debate does get quiet when half the story is removed.

The Chairman Sinclair "Remedy" decision is long overdue and should be out any day now. The Judicial Review is scheduled for November.

Widow, i can't be bothered to read all this.

Did the main guy Hall actually come on here and threaten litigation against avcanada for having this discussion?

If so, so much for freedom of speech.

No. There was one post made by an individual using his real name that included a statement alleged as fact that Mr. Hall had taken a particular action against certain individuals. Hall denied the assertion and demanded that the individual immediately remove the post, "or face the consequences." He made no threats against this Forum or against any of the moderators of this Forum.

It raises an interesting issue, perhaps worthy of a separate thread. The starting point is that he was one of the few posting here who was willing to let his own name stand behind his posts. In my view, that took more than courage, given his obvious role in the controversy, it took a willingness to stand up to critical attacks by those who choose to remain anonymous.

But there comes a point, especially where the attacks are untrue, unfounded or just plain vicious, that one ought to be able to properly react. All of these Forums have guidelines re proper usage, including prohibitions against defamatory posts, but from my experience, there is a wide distance between the guidelines and the actual behavior. To be fair to the moderators, they do not have an easy job, and quite often they may not be alerted to offending posts until after quite a bit of damage is already done.

I can see why the moderators or the owner of this site would be nervous, when the legal fur starts to fly. But there is a real downside to punting an individual who is only demanding that he be treated on the Forum in the manner that the Forum rules dictate. Especially when that person is one who provides a wealth of factual information, albeit, somewhat biased.

The comments in question were made by someone using their own name and were based on facts. There was nothing vicious or untrue about them. We have several ACPA newsletters to that effect... Haven't heard what the final outcome was.

The issue is closed. The post was removed. However, I can assure you that the content of the post did not come from any
ACPA Newsletter. It was personal, and it has been dealt with.

All the parties to the Vilven-Kelly Tribunal hearing were informed this morning that the Tribunal's decision will be released Monday, November 8th, at 9:30 AM Eastern time.
