Hi,

I have a few questions and I want to see if anyone here knows how things are. I am also going to ask someone in TC personally, but I want to check here first.

I can't find anything in the FAA regulations that forbids an FAA licensed instructor from instructing people for their FAA license here in Canada in a Canadian registered airplane. With the possible exception of solo, which would probably need to happen in US airspace, everything else can theoretically be done in Canadian airspace with a Canadian airplane.

Questions:
1) Do you know of any TC regulation that would prevent me from renting a Canadian owned airplane here in Canada and providing flight instructing for an FAA license? (I can provide the instructing with my FAA CFI rating, and I can rent the airplane with my Canadian CPL)

2) Do you know of any law that would prohibit me getting money for this service? (I can get paid against my Canadian CPL and pay taxes to the Canadian government, and I'm a Canadian citizen)

You can't get paid to fly someone around unless it's the student's airplane.

Is this for any flying or only for flight instructing? If it is only for flight instructing then does it catch the case for FAA flight instructing or is it only for relevant when going for TC?

Also, what if I lease an airplane...? U.S. registered or if possible to lease Canadian?

“flight training service”
“flight training service” means a commercial air service that is operated for the purpose of conducting flight training; (service d’entraînement en vol)

406.03 (1) Subject to subsections (2) and (3), no person shall operate a flight training service in Canada using an aeroplane or helicopter in Canada unless the person holds a flight training unit operator certificate that authorizes the person to operate the service and complies with the conditions and operations specifications set out in the certificate.

It doesn't matter which is the state of registry of the aircraft, or towards which nation's licensing requirements the training is conducted: if you're operating a training service in Canada, and using an aircraft in Canada, you need an FTUOC except under the narrow exemptions listed in the CARs. Just like Canadian flight instructors.
