The FAA and US courts have agreed that advertising seats on a flight is in fact advertising a commercial air service.

At least the FAA has a staff devoted to giving answers to that kind of question. It's impossible to get any kind of advance opinion from TC.

There are some new apps or whatever starting up to link seats on commercial aircraft to people who want to travel with a random operator. They are brokering the spots really.
I don't really like the idea of using gypsy cabs so gypsy aircraft are completely out of the question. So what if some pilot person has a shiney new TBM for an uber good deal, there is no standard for airworthiness or competency.

The taxi cab model is broken. Uber would not work if people weren't fed up with what is being offered. Expect to see more - unless you have an open mind you're going to be tested severely in the next while.
