Interim Certficate of Registration (Transfer Ownership of Aircraft)

Post by anthonyp »

I just received my C of R today. Hoping someone can shed some light on C of R's and the transfer of ownership.

According to https://tc.canada.ca/en/aviation/regist ... p-aircraft, to get create an Interim C of R, "I should fill out my name, address, and date of custody and control information on the certificate of registration you received from the previous owner and keep the document on the aircraft".

A little lower it states, "if you have an old version of the certificate of registration, without the portion used for the interim certificate, you can’t use the procedure described here. You must wait until you get your new certificate."

I'm trying to determine if I have the document I have is the C of R that will allow me to use it as an Interim C of R or if I need to wait the 60 days to get issued a new one from TC.

I've emailed TC for the exact answer, but knowing their service levels, it will be a while before I hear back.

Also forgot to mention that I've already paid for and filled out the APPLICATION FOR REGISTRATION OF AIRCRAFT (26-0522E) and submitted my documentation to TC.

I'm trying to determine if we can just go flying using this existing document as the Interim C of R or if we need a new one issued. Nothing on my C of R states that it can be used as "Interim" C of R.

What do you mean by you received your C of R today? If you received your C of R, why do you want an interim C of R?

When you buy a plane from someone the interim C of R is the same piece of paper that was the Certificate of Registration showing the previous owner, that you filled in on the back with your own name and address in the appropriate blank spaces.

If you don’t have that specific document from the previous owner, (maybe they forgot to give it to you) then you do not have an interim C of R, and you may not fly the aircraft, until a continuing C of R arrives from TC showing your name. But … you said that already arrived… so .. it’s a bit confusing what you’re asking.

You may have answered my question, but I'll re-clarify my question.

Today I received by way of post the C of R from the previous owner with his name / address on the front. I had redacted his information in the first image in my original post.

According to https://tc.canada.ca/en/aviation/regist ... p-aircraft, while I "wait for (the) aircraft to be re-registered, (I) can activate an interim certificate of registration. To do this: Fill out your name, address, and date of custody and control information on the certificate of registration you received from the previous owner. Keep the document on the aircraft".

Essentially I want to ensure that the document I have in my position (the original C of R from the previous owner) is the document that the link above is citing to use to "activate an interim certificate of registration".

The added confusion stems from the wording at the bottom of the TC document. It states: "if you have an old version of the certificate of registration, without the portion used for the interim certificate, you can’t use the procedure described here. You must wait until you get your new certificate.[/i]".

I am trying to ensure that I can fly using the C of R that I had received today from the original owner and that I do not have to wait for TC to issue me a new certificate. From the sound of your reply to me, it seems that I can't.

I want to ensure that when the plane flies prior to me receiving a brand new C of R from TC with my name on it that it can fly legally and without consequence.

The last C of R I got from TC was an emailed PDF to print out myself. The interim C of R is another sheet - again, to print myself.

In any event, the interim C of R is very obvious, as it says "Interim Certificate of Registration / Certificat d'immatriculation intérimaire" in BIG white on grey letters across the middle of the page and has spaces for you the new owner to pen in your details. LIke this:

If you don't have that sheet, then you don't have an Interim C of R to use. You're required to return the old invalid C of R with the application for new registration (I guess that answers the question about whether it's on a separate sheet or not - it must be.) Ask the previous owner to make sure to send you the interim one too, otherwise you'll have to wait.

As mentioned, your original post was a bit confusing. As you later clarified, you meant that you received the CofR from the previous owner. If that CofR has no Interim CofR attached, then you do not have what you need to fly the aircraft yet. You will need to wait until you receive the new CofR from TC.

Old planes that haven't had any change of ownership for a while don't have interim C of Rs on their registration certificates.

I ran into that with my plane. And for crying out loud I was just taking my deceased dad off the co ownership spot. I seem to recall we sent it to winnipeg as they were not as backed up as toronto at that time. but I have heard horror stories since. Imagine buying a car or a boat, or an atv, or a motorbike, or a tractor, or a lawntractor, and not being able to use it for like 4-6 months!!
to be fair, years ago, TRansport did warn us to change our old cert of Reg to the new type...

That's when you call your insurance company and ask if they care if you would fly it without a CofR.

As an AvCanada discussion grows longer:
-the probability of 'entitlement' being mentioned, approaches 1
-one will be accused of using bad airmanship
