The major airlines in the US don't want to have a reasonable time limit with regards to passengers being held on aircraft during unscheduled delays to flights put into law.
Is is just the bottom line making the call here? Whatever happened to passenger welfare? Commercial aviation has come far since it's beginnings when airlines tried anything and everything to make the trip more pleasant. Passengers now are just considered to be cattle?
How long do you have to be held before it`s kidnapping...
Is too long not long enough?

Having a standard that pilots lose their licence after making a mistake despite doing no harm to aircraft or passengers means soon you needn't worry about a pilot surplus or pilots offering to fly for free. Where do you get your experience from?

I don't think its kidnapping, afterall I've never heard of a ransom note <LOL>- however, I think you could make a case for forcible confinement. Reduced passenger service and stuffing the passengers in like sardines has made me claustrophic - maybe I better get my pilot's license so at least I can sit up front LOL
