Address Change Fine?

Hello All,

I have received a letter from TC Enforcement says I did not change my address within the specified time period of 7 days when in fact I did. I called the TC office before I moved with the address but the admin person I talked to was a temp filling in for maternity leave. This info obviously did not make it to my file and has come back to haunt me.
bad does this look on my "record"?
My question is does anyone know the fine for this violation? Is it worth fighting? How What would a lawyer for something like this cost? Any recommended lawyers in the GTA/SWO area you know of?

Any help is appreciated.

When I moved, I called a 1-800 # and ended up leaving a message on a machine with my new address. No confirmation if anyone ever got it....... but my safety letter keeps going to my old address. (so maybe not?!)
Are they telling you they are going to fine you? Or was the letter just to inform you of what you apparently did not do?
Until they send you a registered letter telling you are being violated, screw em, who cares? And what "record" are you worried about? (I am reminded of a George Carlin skit.... "the world is going down the tubes".......What F$#@*&^ Tubes?!!! where do they go? whats at the other end?! lol)

Some gov. worker with nothing else better to do has stumbled upon something easy to do that could take lots of their time, making them look busy while avoiding harder...er more important work.

If all the letter says is you did not change your address in the time required have a nice day, use it to start the woodstove and forget about it.

Did they send that letter to your new or old address?
... if it was to your new address, ask them how they got that info and when.

Can't you just tell them that you had moved, but were keeping the previous address as a mailing address until you were fully established at the new place?

I'd send 'em a polite letter explaining what you just said here, and ask for forgiveness, I'm terribly sorry, it won't happen again, etc...

400.07 The holder of a permit or licence shall notify the Department of Transport of any change of permanent address within seven days after the change.
For a first offence an offender might be looking at a something in the area of $200 to $300 or a 2 or 3 days suspension. In your case, I wonder what brought this to light? Something brought it to Enforcement's attention, and whatever it was may affect any sanction levied.

Having said that, if you did notify a clerk & TC dropped the ball, you're not guilty of any offence & you should send them a nice letter explaining same. That costs you a stamp & should end the issue. Remember, the burden of proof is on the Minister: you don't have to prove you're innocent, they have to prove you guilty. If you advised them, don't fudge the truth--just tell it.

If I understood your first post, you received a letter by priority courier from Enforcement saying they had information indicating a possible contravention of CAR 400.07 and inviting you to participate (within 30 days) in the investigation. If that is the case, the worst thing you can do is ignor the letter. It will not go away, & if you ignore it you will very likely receive a Notice of Monetary Penalty. Then you can try to explain your story to the manager (instead of the inspector), pay, or go to the TATC. Far better to set the record straight at this point. And speaking of 'record', once you have one, any future contraventions cost you more, not to mention the fact that employers care (because insurance goes up when you have a 'record'). Even if you did neglect to advise TC, this isn't a safety issue and your circumstances might just result in a slap on the wrist (oral counselling).

Happy to see our tax dollars hard at work. Just imagine the implications if such heinous crimes were left unpunished! Oh, my Gawd! The repercussions! This kind of mindlessness disregard for regulations can only lead to wholesale anarchy! We just can't allow such disregard for important, life saving legislation! Hire more enforcement staff! Way to go TC! We can all rest easy in our beds tonight knowing that we are being protected by such diligent folk.

Doc I am very disappointed in your attitude.

Obviously you do not understand the repercussions of being convicted of such a serious breach of the rules. It is also obvious you do not understand that it may prevent you from getting that once in a lifetime job down the road when they find out you have a record for such a serious violation of the rules.


If you ever get one of these letters P.M. me if you want me to use my influence with T.C. to get them to give you a break....but first you must work on that unprofessional attitude you have.

Isn't there something like 6 people working for Transport for every pilot in Canada? Some posting here think there should be more :rolleyes: How did they find out your address changed anyway?

They'll have a tough time explaining the need for a tribunal based on you being homeless.

talk to them if that doesn't work talk to a tribunal

This is the first I've ever heard of this kind of thing. I've moved several times in my career and never once thought to give Transport a heads up. They get my change of address on the next medical. I have the post office forward any mail to my new address. This sounds like a load of horse hockey to me. Course I like to live out there on the edge, sometimes I leave my seat belt off as well. :roll:

Its BS in my opinion. TC still sends all their documents and safety letter to my old address but my current address is on my license. If they cant get sh** straight on their end, why do you have to?

I have moved 12 times in as many years. Not once did I update my address aside from doing my medical, never heard about this till now. Wow is all I have to say, and I'd be inclined to politely tell then to pound sand.

This issue is actually something that should be taken seriously if T.C. can actually fine you for not sending them an address change within xx days of moving from one place to another.

If they do fine you it really becomes a problem, especially if you can't afford to pay the fine.

Assuming they can fine you there is a simple way to avoid the problem.

Get a post office box anywhere in Canada as your mailing address and problem solved.

Then you can move every day if you so desire and they have your mailing address and can not fine you.

You said you called in and gave them your new address. Reading that CARs quote, I see nothing that says it has to be in writing. I'd tell enforcement that you did provide the info (by phone), period, end of story.

I asked earlier in this thread which address they sent the letter to (old or new), but assuming it was to the new address - they obviously did get the info. So, as KAG mentioned, I'd also tell them to "pound sand".

If you tell a T.C. enforcement person to " pound sand " what are the chances said enforcement person will fine you for the infraction regardless of the validity of alleged infraction?

Do you have a copy of your phone bill from around the time you called ... something to use as a phone log, showing when you called? Does anyone know if TC logs incoming calls (as I know many large organizations do)?

The likelihood that TC will log your incoming call is directly proportionate to the number of threats, pranks, harassment or other hoaxes you plan on making.

TC don't log incoming calls that I've ever heard of, but I do know of some individual inspectors that did.
