Barrie, Ont. — Yellow police tape fluttered around the perimeter of a Barrie mini-golf course Monday afternoon, the only outward clue of a grisly weekend murder that left a father dead and three teenagers in custody.

Putting Edge, a glow-in-the-dark mini-putt course billed as a centre for family fun, was temporarily closed as police continued to investigate a crime that has stunned residents, in part because of its unlikely setting.

“I’m just puzzled. I’m terrified, myself,” said William Dungey, who works next door at a pizza restaurant on Commerce Park Drive. “I will never go in there.”

Bradley Hubbard, 42, of Collingwood, died Saturday after being stabbed in the neck with a broken putter, police confirmed Monday. Three teenagers from Innisfil have been charged with second-degree murder. Brothers Justin, 18, and 19-year-old Matthew Spring, along with family friend Jake Workman, 18, sobbed continuously while sitting in a prisoner’s box dressed in prison-issue clothes at a court hearing on Monday.

In a statement outside the Barrie courthouse, Shelly Spring, stepmother of two of the accused, said the teenagers are “not monsters.”

“They didn’t go in there to kill somebody,” she said.

Mr. Hubbard, along with girlfriend Stephanie Reid and two daughters, was at the Barrie mini-golf course Saturday evening when a confrontation broke out between the victim and a group of young men.

Mr. Dungey, who said a couple of dozen people witnessed the commotion next door, recounted details of a graphic scene. Teenagers were “smashing things” inside the golf course before the victim reportedly tried to intervene.

“My daughter told them to stop it because the girls were crying, that’s how bad they were,” Brian Reid, Stephanie Reid’s father, told CTV reporters on Monday.

“They told her to go to hell. And then Bradley stepped up and said, ‘Not in front of my family.’”

Mr. Hubbard was known by friends and family as a “gentle giant,” but at a solid 6-foot-4 with tattoos a shaved head, he cast an imposing figure.

Verbal insults escalated into a physical altercation that ended with Mr. Hubbard being stabbed in the neck with a broken putter.

He collapsed to the ground, the wound “gushing” blood, Mr. Dungey said.

Mr. Hubbard was later pronounced dead at Barrie’s Royal Victoria Hospital.

During their court appearance on Monday, the three were sobbing inside the prisoner's box, CTV Toronto's John Musselman reported. Calista Spring, sister of two suspects, said "I've known these boys all my life (and) they are not these kinds of people."

They killed a guy in front of his little girls. What kind of people are they? Now they're going to say, "Sorry, we didn't mean it."? Didn't the movies show them what happens when you stab a guy in the neck?

I kind of suspect none of the people that should have been parenting them ever bothered stopping them from stick fights with the lecture on what could go wrong.

Wait until these s-heads lawyers get on it. They'll be the victims who were only defending themselves from a 6'4" giant vigilante who had them in fear for their lives over harmless teenage hijinx. If they don't walk away free, the most they'll get from our lame brain judiciary is a manslaughter conviction with a conditional sentence.

Restoritive Justice would work perfectly in this case, as Wilbut pointed out these kids are the victims in this. :roll:

Come on folks .... they cried in court .... isn't that enough of a penalty to keep you happy?

Jeeze you guys, have you no ability to feel their pain and gut wrenching anguish over being caught? .... err, I mean ..... over having played a practical joke that went poorly due to having made "inappropriate chioices?"

They were probably subjected to the unspeakable humiliation of being led into court wearing handcuffs ... maybe even demeaned by being shackled. Isn't that enough for you louts who probably would have cheered for the lion in Roman times?

A little thing like breaking a putter, and stabbing some interferring know-it-all do-gooder in the neck while his wife and young children watched shouldn't be made into such a big deal .... as one of the witnesses said on TV, "He got to die in his wife's arms, and tell her he loved her" .... who could ask for a more pleasant way to pass on into the next life?

So, why would anyone ask for more severe treatment than asking the supposed perpetrators to cry on cue in court ... like an accomplished soap opera actor.

According to the Liberal Party of Canada doctrine, the legal system emphasis should now be placed on rehabilitation of these young fine upstanding citizens who momentarliy lost their way when provoked. Pretty soon they will be realeased to become productive members of a bike gang .... errr ... I meant .... productive members of society, likely to be nominated for a Nobel Prize.

BS I say ... throw the scum into prison for the next 50 years without a change of straw in the dungeon, and let rats bite off their toes and fingers.

You guys sure thought it was at the G20 among others, these a$$holes deserve whatever comes their way however harsh...they are not kids, they knew what they were doing and now its time to pay the piper. But the bleeding heart lefties will find a way to make sure these guys have a protected cell with satellite tv, hot showers and 3 squares a day cus anything less is cruel and unusual punishment....what about the kids that will be haunted for the rest of their lives and watching their dad collapse dead in front of them with a f'ing putter in his neck....grow a pair dude, this should be cut and dry and these germs should not be able to infect our society ever again.

it's suposedly proven that the death penalty is not a deterrent in cases like this.

I don't know how I feel about it being used in this case. Only one of them actually killed the victim. Yet I feel all three should be held highly and nearly as accountable. I'm not against capital punishment, especially in a case like Paul Bernardo. 100% reduction of repeat offense after and that is important in my opinion. Something like this is bad enough. Someone going to jail getting out and doing it again? Not if I were king!

I'm angry about this and have no problem with justice being served but do understand as horrible as this is and though it does not relieve them of being responsible for their wrong choice. The intent was not to kill.

I believe it is man slaughter not murder and it is still a big difference.

You're right, these guys should not get a fair trial, we should not look at any of the evidence, and there should not be a proper investigation. They should just be executed with out any due process.

I think that a good course of action would be for the police to do their job and conduct an investigation, gather evidence and for the crown to prosecute them.

I then think that the good course of action would be for the judge or jury to weigh the evidence and decide if these people are guilty of the crimes they are being charged with.

I then think the good course of action would be to carry out a sentence that our society has decided is fitting to the crime they have committed, again should they be found guilty.

What I think is a poor course of action is talking about how great it is that the USA has the death penalty, and what should be done to these three when they have yet to go to trial. As far as anyone here is concerned we should be consulting the long drop chart before the court actually decides they are guilty.

Wow. You are so much smarter than everyone else. Thanks for writing things for us to learn from.

We don't even know if the police have the right suspects. I hope they can gather good evidence for the judge or jury to consider. Maybe that guy that had blood shooting out of his neck is a big faker. Or his little girls did this and are trying to tattle on those guys because they don't want to get in trouble for killing their dad. Kids these days.

I think I speak for the other meanies in the thread when I say we all hope the fellas arn't "guilty" that would be a shame if they really killed a guy.

If the police somehow gather evidence in this case and the worst thing that all of us hope against is true and somehow they are found guilty by those qualified to figure out such difficult things. I sure hope society decides on a light sentence for the little rascals.

Perhaps I need to publicly apologize for not thinking it through because I'm not as smart as you.

I'm going to guess only one did the deed. Gas him and make his friends watch. No symothy here. They may be young but they are old enough to know when you stab someone in the neck bad things happen. My heart goes out to the family of the victim.

SHERIFF JOE IS AT IT AGAIN!

You all remember Sheriff Joe Arpaio of Arizona’s Maricopa County, who painted the jail cells pink and made the inmates wear pink prison garb. Well ………. there’s MUCH more to know about Sheriff Joe!

Maricopa County was spending approx. $18 million dollars a year on stray animals, like cats and dogs. Sheriff Joe offered to take the department over, and the County Supervisors said okay.

Sheriff Joe Arpaio MaricopaThe animal shelters are now all staffed and operated by prisoners. They feed and care for the strays. Every animal in his care is taken out and walked twice daily He now has prisoners who are experts in animal nutrition and behavior. They give great classes for anyone who’d like to adopt an animal. He has literally taken stray dogs off the street, given them to the care of prisoners, and had them place in dog shows.

The best part? His budget for the entire department is now under $3 million. Teresa and I adopted a Weimaraner from a Maricopa County shelter two years ago. He was neutered, and current on all shots, in great health, and even had a microchip inserted the day we got him. Cost us $78.

The prisoners get the benefit of about $0.28 an hour for working, but most would work for free, just to be out of their cells for the day. Most of his budget is for utilities, building maintenance, etc. He pays the prisoners out of the fees collected for adopted animals.
I have long wondered when the rest of the country would take a look at the way he runs the jail system, and copy some of his ideas. He has a huge farm, donated to the county years ago, where inmates can work, and they grow most of their own fresh vegetables and food, doing all the work and harvesting by hand.

He has a pretty good sized hog farm, which provides meat, and fertilizer. It fertilizes the Christmas tree nursery, where prisoners work, and you can buy a living Christmas tree for $6 – $8 for the Holidays, and plant it later. We have six trees in our yard from the Prison.

Yup, he was reelected last year with 83% of the vote. Now he’s in trouble with the ACLU again. He painted all his buses and vehicles with a mural, that has a special hotline phone number painted on it, where you can call and report suspected illegal aliens. Immigrations and Customs Enforcement wasn’t doing enough in his eyes, so he had 40 deputies trained specifically for enforcing immigration laws, started up his hotline, and bought 4 new buses just for hauling folks back to the border. He’s kind of a ‘Git-R Dun’ kind of Sheriff

TO THOSE OF YOU NOT FAMILIAR WITH JOE ARPAIO – HE IS THE MARICOPA ARIZONA COUNTY SHERIFF AND HE KEEPS GETTING ELECTED OVER AND OVER THIS IS ONE OF THE REASONS WHY:

Sheriff Joe Arpaio (In Arizona ) who created the ‘ Tent City Jail’: He has jail meals down to 40 cents a serving and charges the inmates for them.
He stopped smoking and porno magazines in the jails. Took away their weights Cut off all but ‘G’ movies.

He started chain gangs so the inmates could do free work on county and city projects.
Then He Started Chain Gangs For Women So He Wouldn’t Get Sued For Discrimination.

He took away cable TV Until he found out there was A Federal Court Order that Required Cable TV For Jails So He Hooked Up The Cable TV Again Only Let In The Disney Channel And The Weather Channel.

When asked why the weather channel He Replied, So They Will Know How Hot It’s Gonna Be While They Are Working ON My Chain Gangs.
He Cut Off Coffee Since It Has Zero Nutritional Value.
When the inmates complained, he told them, ‘This Isn’t The Ritz/Carlton…… If You Don’t Like It, Don’t Come Back.’

Maybe if all prisons were like this one there would be a lot less crime and/or repeat offenders. Criminals should be punished for their crimes – not live in luxury until it’s time for their parole, only to go out and commit another crime so they can get back in to live on taxpayers money and enjoy things taxpayers can’t afford to have for themselves.

Well at least one of them will probably go down for second degree murder. Kinda hard to argue that you didn't intend to kill him when you stab him in the neck with a sharp metal object, but it's still not a sure thing.
Self-defence in case of aggression

35. Every one who has without justification assaulted another but did not commence the assault with intent to cause death or grievous bodily harm, or has without justification provoked an assault on himself by another, may justify the use of force subsequent to the assault if

(a) he uses the force

Murder reduced to manslaughter

232. (1) Culpable homicide that otherwise would be murder may be reduced to manslaughter if the person who committed it did so in the heat of passion caused by sudden provocation.

(2) A wrongful act or an insult that is of such a nature as to be sufficient to deprive an ordinary person of the power of self-control is provocation for the purposes of this section if the accused acted on it on the sudden and before there was time for his passion to cool.

Questions of fact

(3) For the purposes of this section, the questions

(a) whether a particular wrongful act or insult amounted to provocation, and

(b) whether the accused was deprived of the power of self-control by the provocation that he alleges he received,

are questions of fact, but no one shall be deemed to have given provocation to another by doing anything that he had a legal right to do, or by doing anything that the accused incited him to do in order to provide the accused with an excuse for causing death or bodily harm to any human being.

Death during illegal arrest

(4) Culpable homicide that otherwise would be murder is not necessarily manslaughter by reason only that it was committed by a person who was being arrested illegally, but the fact that the illegality of the arrest was known to the accused may be evidence of provocation for the purpose of this section.

Even assholes have the right to self defence, though it is still limited in scope. We don't really know what exactly the guy did when he intervened, so it's *possible* that he may have gone too far and provoked the 3 accused further, or necessitated their defending themselves. No doubt the lawyer for the one who actually stabbed him in the neck with try for this, but without further info it's impossible to say whether it's BS or not. There's also an intoxication defence, where they could argue that they were too drunk to *intend* to kill him, which could also reduce it to manslaughter.

This is why we have trials, to ensure that when at least one of these guys gets sent to prison for 10 years, it's for the right reasons. Public opinion is often wrong, and heavily biased by those who were interviewed by the press. Note that we've really only heard one side of the story. It may be that all 3 of these guys are guilty as hell and deserve no sympathy at all, but we don't know that yet.
