If you're a passenger and you don't keep your seat belt on (even if it's fairly loose) then you should be woken up and given a Darwin award. If you injure other passengers or crew as your ass goes flying around, you should be held liable for their injuries because you're a negligent idiot.

It sucks that this FO was disoriented and took evasive maneuvers, and likely sleep inertia was a contributing factor. However, I'm sure he truly believed he had to prevent a mid-air collision. What if another aircraft actually was going to have a mid-air collision with them? He'd be a hero for taking control and avoiding a disaster.
