Balanced field length

Balanced field length
Here's the scenario:
B1900
Balanced field length numbers are based on flap 17
All other requirments are met as normal
*flaps are INOP (MEL'd) at flap 0 setting
You use the numbers v1, vr, v2,v enroute based on the above....so they are calculated based on flap 17 setting.
Is this legal? What if you have an engine failure at V1? What's the point on figuring out a flap retraction speed if they are INOP? I'd like to hear your opinion. My opinion is this is not legal because balanced field length is not met therefor you would have to block the plane down to 9 seats...am I close to being right here?

The MEL should have an operational procedure that will detail the performance penalty you have to apply.

In the afm there should be numbers for flap 0 and 17 as well bleeds on and off
...with flaps 0 you will also only have 2 bugs as v2 and venr become the same value

Ok I'll look into that. From what I understand they are using normal t/o, flap 17 numbers with the flaps MEL'd. Thanks for the responses
