probationary period

I got hired on the 3rd of June and my probation would be over on second of December.
On Nov 26, once I arrived at my job, the CSM was waiting for me and we went to a meeting with union and the liability manager, CSM read a letter to me " based on your performance, you have been deemed not suitable for the position of CSS.
It was so inexpected. I could not believe it. I asked why? Your performance is not good? where is not good ? At the gate? I'have just finished my training and I have another day of shadowing to perform and all 610 paper where I was the control agent is there. All the flight was on time or left early. What are you talking about?

we have the right to terminate the contract within 182 days, It's your probationary time.
Ok but why?
No answer. Only sadness du to unfairness.

I called the manger of above the wing? Told him my situation and that I do not understand the decision. He told me he will check.

Few days later, I talked to him and he told me some situatation he has been told by a lead which I do not remember at all and I think it's a lie
- she did told me to bag a tag at the gate and I left ..
- I borded a passenger with infant and the Apis for infant was missing

I told him, I do not remember such a thing and everytime I am an assist on a flight and I have to leave for another assignment, I asked If my job was finished there. And for Apis missing of an infant, If it's true, The mistake happens all the time and you can not fire a person based on that. And I do remember him that I passed my training over 80% and I have still one day of shadowing to finish my training.

He told me, unfortunately it's where he stand (by what the lead has told him) and there is no mistake of firing me and If I am still concern about that, I should go and see the union.

I do not know If the union can help me. What if they continue to bring in some other lies.

I think they did not have the right to terminate my contract like this. Do you know what can I do?

FYI: In my contract, it has been mentionned, that I will have two performance review during my probation. I did not have any of them.

Ouch! Sorry to hear of your predicament.

Employment law isn't my strength, but Id imagine that the company has done things pretty much by the book in terms of terminating your employment. While they may have been required to give you 2 performance appraisals, and you might win a grievance based on that, it seems that they do not want you working there - so do you want to still work there anyway?

Better to chalk it up to experience, and try again somewhere else, sadly..

I'm pretty sure during a probation period you can be let go for any reason or no reason at all. I'd try to learn from the experience so you don't make the same mistakes again, then put it behind you and move on. CSR work can be very demanding in many ways and is not for everyone.

I got fired during a probationay period once, basically for reasons beyond my control, basically small misunderstandings and prejudice, as I was not allowed to work my way out of these misunderstandings and prejudices no matter how I tried.

Anyway, I took it to the union, even though I was in my probationary period, and it was determined that the company didn't follow their own internal procedures to fire me in terms of allowing a corrective action plan and proper warnings, they just didn't like me and ended it. So it took a while, and eventually they offered me my job back, but I'd already moved on, so I was happy with just an apology and my record of termination changed into a resignation.

But you need a union person willing to fight for you, some obvious injustice, and a lot of time on your hand to get anything out of it. If you don't have all those things I'd suggest you move on, not the end of the world, sometimes people just don't gel at an employer, and petty differences cloud better judgement. Not that that's much consolation.

During a probationary period, up to 90 Days, the company can let you go without any reason at all.

You may not ever know why, as the manager doing the dirty job may say something or give a reason that makes no sense, which in the end gets all the other labour folks involved. Due to this, you may never know the reason for termination as the company has no legal obligation to tell you.

Sorry, that this happened. But as said do you really want to fight to work for a company that does not want you?
