What are the fines and penalties for viloations

Post by Road Trip »

In regards to commercial operations.

I've heard over gross is $25,000
What are some of the other fines such as exceeding duty hours or days. Not having your licence with you. Not having log books in the plane. Failing to fill out log books in a timely manner etc.

I'm trying to convey the necessity to follow the rules to some non aviation types and they best understand when it's conveyed in the form of $$.

genuine mistakes often require corrective action but most of the time won't get a fine. eg you took off over gross weight and realized it after that at some point extra stuff got thrown on the plane by accident transport would prefer to see the company take corrective action to make sure this doesn't happen again than just blindly throw out fines (well at least from what I've seen) although if it was an operator that was always over gross and this was the way they ran the operation then its a different story

The links referred to above are the legal maxiums.

fish4life is correct thanks to SMS.

IF a commercial operator's activities are referred to & investigated by Enforcement, and IF an offence is found to have occurred, the Enforcement Division have an internal document recommending penalties for each reg. Penalty recommendations are based on whether the offender is private or commercial, and if this is a 1st, 2nd, or subsequent offence. The Regional Manager assessing the penalty also has descretion to vary the recommended penalty based on mitigating or aggravating circumstances.
